yeah, repair is all approved, just waiting for the numbnut that hit me to pay his excess so mine can get fixed.

insurance company and insured have been given a deadline to give me the go ahead or legal action will be taken.

If you go legal action and no excess has been paid, The insurance company will just wipe there hands of the other person until he pays the excess. Now if he does not pay the excess and you go legal and you go directly through the other person and he can not pay for repairs and the solicitor can not recover the money. You may end up with the bill from your solicitor so just be careful.

thats pretty much what they have done already, they wont do anything other than saying theres nothing they can do until he pays it. yet he says they havent told him he needs to pay it before mine gets fixed.

he works interstate, so i have no idea when his is getting fixed, the insurance company wont tell me.

They would of told him he had an excess when he lodged the claim, I would assume, and probably even sent out letter to him. I know AAMI does that.

Now what I would do, if you have not already done so, is send the actual guy a letter of demand. This may get it in his head you are serious. Usually scares people also.

Another thing to do if you had fully comprehensive insurance is to contact them. Even if you have third party, they may have some info on where to go to get help.

i think its totally repairable.. doesnt seem to be much damage there at all..

anything is repairable... its whether or not its worth repairing when its value comes into it as well.

You shouldnt need to go through his insurance, do it through yours and let them sort it out for you.

If they write it off - you always can buy it back and fix it yourself.
My car was written off due tyrewall has been pushed in.

it was actually pretty close to being written off, repair at 3.5 and they valued it at just over 5k. all it would take if the damage to a little worse and the repair bill could easily match or exceed the value.
