I have been cleared of my last 3 fines ( probably over $700 worth ), yes they we not my fines ( incorrectly issued to me ), all i say is you know inside f you are guilty or not, and if you believe your not guilty back yourself in for the long haul, however if your just hoping for a free ride forget it and pay the bill and do the time.

Imagine if all people that received a speeding fine decided to contest them, would bog the the court system down for years........

You could try and do this
Q: This if my first speeding infringement. May I be given a caution?
You can apply for a caution which is decided by Police in their discretion. The criteria they consider include:

You have not had a speeding or traffic offence within the previous three years
You have held a full driving licence for a minimum of three years
You admit the offence
Your alleged speed was within 10kph of the speed limit applicable
You have not had a caution within the last three years
The same criteria applies to a driver who has not had a previous speeding or traffic offence within the preceeding five years, has held a full driving licence for a minimum of five years and the alleged speed was within 15kph of the speed limit applicable.
For further information and details of how to apply for a caution go to Official warnings.

Or ask to look at the certificate of calibration, and if it hasn't been done in the last 6 months, then legally the camera is faulty and the fine will cancelled (but good luck trying to find this piece of legislation)

Well It must be different here in SA, they arnt allowed to take pictures of the front of our cars speeding because of the privacy act.Always the back of our cars, whether its a mobil speed camera or a traffic camera.Only radars are allowed to be pointed at your front because it doesnt take a picture.I seriously until now havnt seen or heard of anyone being done front on...wierd.
But yes i would contest the speeding fine, if you generally werent speeding but its your word against the photo i guess, maybe get the courts to prossicute the other guy aswell so atleast its fair.

By all means seek advice but make sure it's from someone who is qualified. After all it's your money. Apart from a lot of letters next to their name they can also be recognised by the fact they are are the most expensive. Why? Because they can show previous results. There are far too many supposed experts these days looking for their 5 minutes of fame on ACA or some similar show. With no real idea once the hype is pushed to one side and it comes down to brass tacks.

I thought they couldn't fine you if there was more than one car in the pic, or is that only for traffric light cameras?

I've seen camera cars on the other side of the road facing me, and proceed to give a couple of flashes with the lights to oncoming motorists, only to see a "speed cameras save lives" sign a little further down on MY side of the road.

I haven't been done by one of these front on, but I thought they could now get you going in both directions.

I always remember the fines used to have "Q&A" enclosed with them - one of them was "What if there is another car in the picture?". The response was something like "We can tell which car set the camera off", something about "loops" or something. If I wanted I could probably dig this little sheet up, there should be a few around here from around 2003/2004 when I was a dumb moron who never slowed for anything.

as most people are aware there are different laws in different states towards frontal or rear photos ,
in vic either can be applied, although most are rear espically mobile cameras, its up to the camera operator whether it safe for themselves and motorist to shoot frontal ,as for fixed digital cameras it depends on where they are situated taking into consideration other aspects around there placement eg sunlight ,direct wind ,and of cousre do they wont you to see them as a reminder or not.

as for 2 vechiles in the same photo ( mobile camera ) there is a specific area where the radar is beamed across the road , this is where the template is used to show is particular area ,if there are 2 vechiles in this same area then from what i understand the photo is rejected ,which is fairly small percentage of the road way

the same cant be explained for digital photos.

as for certified calibrtion of equipment its not 6 months its 12 months,
also the operator has to calibrate the mobile radar every session against a hand held radar + or - 3km difference not both.

anyway this is my understanding of the vic rules, also from what i have found out by asking a few mobile camera operators ,after explaining i come in peace ,these people must be getting the s#%t scared into them, the person that i recently talked to had full 360 degree cctv with a thick perspex cover over there window with a memeber of the vic police coming past every couple of minutes checking up on them.

den

Hi, I know this is an old thread, but can anyone tell me if admitting to speeding and having a good driving record will still possibly let you off?
Havent had a fine in over 10 yrs but today opened the mail to find a speeding camera fine (106km/hr in a 100 zone & 1 point & $134) from about 2 months ago when I had a hire car in Victoria. Also a bit peeved that Hertz are charging me a $33 fee for the incident also.

send a letter of leniency to vic police address should be on the back from memory, pleading to them that your past driving record is unblemished for (x) amount of years ,you admit to speeding (6km over) for unkown reason and ask them to review your infringment. as long as you dont have any traffic fines i think for the previous 3-4 years they might let you go on this one,
but the next one no such luck.

good luck

all cameras i see in NSW are not radar based, but use a sensor stip in the road just beside the camera location. they are stagered for multi lane roads too.
in this case, you cross the sensors while speeding, you get booked! does not matter how many cars are near you or in the photo, its almost intant when it takes photo.
i sent away for the picture to prove my small INFRINGEMNT of the speed limit, and the photo shows the car only JUST having crossed the sensors in the road less than 30cm at 100km. so they can easy tell which car is speeding.
maybe if you tried driving at around 800-900kph the camera may MISS you!

I am new here and I have been wondering how to approach my speeding fine problem. I got it in Feb 2006 and you mentioned something about being over 12 months old. I have looked on AustLII but can't see anything relevant to it. Can you point me in the right direction please? My court date has been set for 23 August 07 and I am trying to prepare. I have already pleaded NOT guilty obviously at the first appearance (I actually only made a phone call). Also Once it is now in the court process - how do I pay if I decide it is not worth proceeding with? Just the normal BPay ?
