A MAN who dragged a 68-year-old out of his car before repeatedly punching and kicking him in a fit of road rage has been allowed to keep driving, pending an appeal.
Mark James, 47, of Melbourne, was yesterday stripped of his licence for six months, but immediately lodged an appeal and had the licence handed back pending the County Court hearing. James also received a 50-hour community service order after claiming a wrist injury sustained before the bashing would prevent him carrying out too much physical work. Frankston Magistrates' Court heard that James lost his temper and set upon Ronald Mentiplay because he was driving too close. Mr Mentiplay – who suffers a degenerative bone disorder – was left bruised and battered after James punched and kicked him to the head and body as he lay helplessly on the road. Mr Mentiplay said in his victim impact statement tendered to the court yesterday that he believed it was imperative James attend an anger management course. James pleaded guilty to five charges including recklessly causing injury, assault by kicking and unlawful assault. He appeared in court two weeks ago and was assessed for a community based order. After viewing a doctor's certificate, magistrate Kim Parkinson queried how James could still assault Mr Mentiplay despite wrist injuries. James' lawyer, David Tonkin, said his client assaulted Mr Mentiplay in the heat of the moment. Ms Parkinson said she took into account the victim's recommendation and ordered James to complete an anger management course. She convicted James, placed him on a 12-month community based order and ordered he perform 50 hours of unpaid community work. She also cancelled James' licence for six months but granted him permission to drive pending a County Court appeal against his sentence.

Whats the point in anything these days
The criminals get rights and the victims get slapped in the face It happens all the time....Ive had family memebers at the recieving end of Identity Fraud....Physical Abuse....A whole heap of nastiness and system is reluctant to do anything....These issues have long passed but the sytem is retarded my mate got hand cuffed and sent to the lock up for the night becuase he was picking up a branch that another person had snapped off a tree in the valley.. hes going to court becuase he picked up a tree branch |

That's weak, lock him up. But not a weak as the neighbour of my wife's friend. He came at the friend (who is 8 months pregnant) with TWO knives in a dispute over a parking space. And she told the cops not to worry!!

Why isn't Mark james put into a room and punched and kicked to the ground?
The court system is pathetic. If I had seen this poor old bloke beaten by a road rager, I would have stepped in for the front of my car! It's people like Mr James that cause problems on the roads.

I dont see what the problem is?
he pleaded guilty to 5 serious assault charges, true he'll probably get a community based order and wont think twice of it but thats a matter for the courts. I dont see what does his driving licence have to do with his offence? He happened to be driving when he got angry so he should loose his licence? By that logic people who get done with possesion would lose their licence too even though it has nothing to with the actual offence. Think people. |

if he got angry about someone following too closely while driving in his car, of course he should be off the road. He obviously doesn't have the mental state to be driving.

I made the point that i dont think the punishment is enough for most assault offences which you obviously missed! Once again, attacking another driver has nothing to do with his licence unless he used the car as a weapon. Build a bridge or go back to A Current Affair. |

I'm with T_Terror - if James was walking down the street and didnt like how close someone was walking to him, and beat them to the ground, should he still loose his licence?
Of course not, so there is no difference between getting out of the car and flogging someone or just turning around on the footpath and flogging someone. If James had used the car as a weapon and purposely run into another road user, then go for gold, cancel his licence and I'll agree with it. And though I'm sure in this particular case the flogging was undeserved, there are MANY MANY drivers out there who drive in such a way as to DESERVE a flogging - I started a thread in the pub a few months back about it and there were heaps of people agreeing and saying "yeah, some people should be bashed for poor driving" etc etc...IMHO a little well placed road rage would work a lot better than a fine and demerit points with regards to improving the general standard of driving on our roads _2: |

My vote goes to a this dude being a Piner! Quality of drivers and the following road rage around Frankston and Dandenong is a laugh at first then it just gets plain ol scary.

should his license be taken away? YES.
no license = you cant get ****ed off because people are driving too slow in front of you. being angry and bashing people because they are driving to slow in front of you is a direct offense against your license. in theory, according to a few in this thread, if i am a licensed firearm owner and i choose to go shoot someone because they shit me, i should be able to keep my firearms and my firearm license? its the same thing WAKE UP. |

yeah but the guy didn't use his car on the old guy(running over him or anything), where using a firearm with a firearms' license & shooting another person, you should lose your firearms license, of course. along with charges
if someone walking down a street hits another person over the head, he shouldn't lose his car license. i think the guy needs to go to angre management ;) |

T_Terror does have a point. The damage done was related to assault, not a car-related damage (ie. running him over).
Though, the sentence is a bit light.
