A Polish motorist lost his licence after he drove to a police station to ask officers if he was too drunk to drive.
Dariusz Mazowiecki, 33, was breathalysed, arrested and charged following the incident in Bialystok in north east Poland. A police spokesman said: "He had been out drinking with friends and at the end of the night wasn't sure if he was over the limit or not and wanted to find a policeman to ask. "Unfortunately he decided the nearest station was too far for him to walk and so he drove there. "Officers did a breath test and found he was over the drink drive limit. He was arrested and was stripped of his licence."

i thought you could only be charged if you are in the drivers seat with the keys in the ignition (not necessarily engine running)?

reminds me of one that came in street machine a few years ago...
a polish man has gotten off a drink driving charge because he claims that he was drunk when he signed the confession form. police pulled the man over and he gave in to police and admitted he was DUI. rather than do a Breathalyzer on the man they got him to sign the a form admitting to what he was done. obviously when he sobered up he withdrew his confession and seeing as there was no more evidence against him he was let off. or something like that |

I don't carry house keys on me at all, keep them in the car, haven't used in 4 years, just drive to garage and push remote.

a mate of mine was done eventhough he was inside his house when he police turned up. his car was warm, he was drunk and home alone and the police had seen his car being driven. he lost his licence for that one.

Nah we have had a few when we are doing the RBT walk up and want to on the machine to see if they are over or under the limit - if it is not busy we will comply just for a laugh. We had 1 girl pull .15 when she was walking NOW that is freeking high but she could walk and carry on a convo normally.
Must of been use to it and on the other side we had a male blow 0.01 and he sounded and acted really out of it - no drugs we could detect just 2 cans of scotch and cola he told us a real 1 pot screamer although he was under we suggested he park the car and wait for about an hour before he ventured home

I was charged with DUI .06 I was in a carpark on private property and was not driving my car. I had to put some stuff in the car and get a bag out. Walked to my mates car who was the designated driver. While walking the cops said we saw you in that car with your keys. That makes you responsible for the car and hence the DUI.
Private property does not mean jack unless its your private property. It does not matter that it was not driven when I blew in the bag. This is to stop people going to the pub, getting drunk, then sleeping in the car. They may wake up still under the influence and think they can drive. Lucky for me no fine, demerit points, or conviction recorded.

OMG how can you be charge with DUI (Driving under the influence) if your not driving and only going to a car to retreive items out, and to be charged after the fact while sitting at home and the car engine is warm is utter crap, how the do they know that person was driving, so what if he was home alone (unless he was being followed) that someone else had driven the car home, like i said before i would fight this till the cows come home

the guy i was talking about did fight it in court and still lost. he did have prior convictions for dui and lived 30k out of town so he couldnt pull the old my mate was driving line.

I think some people here are confused.....DUI is hardly ever used, and is mainly an offence cops use when no alcohol is detected yet the person still appears under the influence of something...possibly drugs, it is a charge based on observations, ie the cop watching you and records your actions...
What most people get done for is PCA, this is what happens when you get breath tested on the side of the road, and then get charged with PCA ie Prescribed Concentration of Alcohol, .05 in NSW for most drivers.... |
